Please read these terms and conditions carefully. Participation in this promotion will
constitute your agreement to comply with these Terms and Conditions. If you do not agree
with these Terms and Conditions, please do not participate. The terms and conditions set out
below apply to all participants in the Faka iFlava campaign taking place on our official
Twizza Facebook and Instagram.
RULES OF COMPETITION:
1. The name of the competition is “Faka iFlava” (“the competition”) and the promoter is
Twizza (Pty) Limited (Registration number 2012/221184/07), a company incorporated
in the Republic of South Africa, and having its registered address at 1 Arkwright
Street Komani Industrial Park, Komani 5319 (“the promoter”).
2. The competition runs from the 20th of September 2024 and ends on the 31 st of
October 2024.
3. The competition is open to all citizens and legal residents of South Africa (provided
that the participant is also a resident in South Africa at the time of winning and
receiving any prize in this competition), who at the time of entering the competition
are over the age of 18 (eighteen) years and are in possession of a valid South African
Identity Document (in the case of residents, a valid passport, and necessary residency
permits).
4. No employees, directors, agents, or consultants and their immediate family members
directly connected to or in the employment of Twizza (Pty) Limited, their subsidiaries
and business partners, associated advertising or promotion agencies, and staff
members, who within a period of 3 months preceding this competition have won any
competition organised, promoted or conducted by Twizza (Pty) Limited, or who
resides at the same address as such a winner, may take part in the competition.
5. Each participant may only win once for the duration of the competition.
6. Each entry will be audited, and participants stand a chance to WIN one of 5 R2000
Shoprite/Checkers vouchers for nominating their hood, or a makeover to the value of
R50 000.
7. To enter the competition, the participant must:
1. Comment on the correct pinned Faka iFlava post on our official Twizza
Facebook or Instagram page/s by nominating an area within their hood that is
in need of a makeover.
8. Twizza reserves the full right to select winners at its discretion, including from entries
submitted on our social pages or through other means, without the need for further
justification. All winners will be subject to an internal auditing process, involving
vetting and manual checks, to confirm they have met all qualifying criteria.
9. Winners will be contacted via DM on the social media handle they used to enter or the
phone number they have provided. Conversations and other entry details (including
social media handles) may be recorded for security, auditing, and verification
purposes.
10. Winners may be announced on the Twizza Facebook page
(https://www.facebook.com/Twizza), Instagram page
(https://www.instagram.com/twizza/), or the Twizza website at www.twizza.co.za.
11. The Winner acknowledges that the promoter shall not be held liable for any
unauthorized access or hacking attempts, or false winner confirmation made by third
parties.
12. The Winner agrees to exercise caution and diligence in providing any personal
information to the promoter and shall not disclose sensitive information to any third
party claiming to represent the Company.
13. All entries become the property of the promoter and may be used at their sole
discretion.
14. The promoter assumes no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft or
destruction, or unauthorized access to, or alteration of entries.
15. The promoter is not responsible for any problems or technical malfunction of any
telephone network or telephone lines, computer online systems, servers, or providers,
computer equipment, software, failure of any entry to be received by the promoter on
account of technical problems, human error, or traffic congestion on any cellular
device relating to, or resulting from, participation in the competition or use of the
requisite instructions of the competition. Proof of sending will not be accepted as
proof of receipt.
16. Participation in the competition constitutes acceptance of the promotion rules, and
participants agree to abide by these rules.
17. Except insofar as provided for in the Consumer Protection Act (Act 68 of 2008), the
promoter’s decision is final, and no correspondence will be entered into after the
competition’s closing date.
18. Prizes are not transferrable and cannot be converted to any other prize. The promoter
will provide the prize within 3 calendar months from the date of their winner
announcement on the Twizza official social page/s or as soon as is reasonably
possible.
19. Twizza reserves the right to make the final decision regarding the execution of the
R50,000 makeover prize, including but not limited to the nature, scope, and specific
elements of the makeover that will best serve the selected community’s needs. This
prize is a one-time contribution, intended as a standalone initiative, and does not
imply or guarantee any ongoing or future support for the community.
20. The promoter or its agents, associated companies, nor any directors, officers, or
employees of such, do not accept responsibility or liability for any loss or damage to
goods or personal injury, whether direct, indirect, consequential, or otherwise arising
from any cause whatsoever, suffered as a result of participating or winning this prize,
and will also not be responsible or liable for any further expenses or fees required for
the purpose of using, applying, or enjoying the prize won in the competition.
21. The promoter shall have the right to change or terminate the competition immediately
and without notice. In the event of such change or termination, all participants agree
to waive any rights that they have in respect of this promotional competition and
acknowledge that they have no recourse against the promoter or its agents.
22. The promoter reserves the right to publish any images taken of the participants for
publicity purposes in any manner they deem fit, without any remuneration being made
payable to the participants. However, the participant has the right to object to these
images being used by written notification to the legal department of the promoter or
its agents.
23. The competition is in no way organised, endorsed, or administered by, or associated
with Facebook, LinkedIn, Instagram, X, or any other social media forum.
24. By participating in the competition, participants consent to the transfer, storage, and
processing of their personal information. Participants may withdraw this consent at
any time by written notification to the promoter at marketing@twizza.co.za. The
promoter and its affiliates will collect and use the personal information:
1. To enable participation in this competition,
2. For activities related to this competition,
3. For the promoter’s, its affiliates, and subsidiaries’ marketing purposes,
4. For communication to participants about products and offers from the
promoter.
25. The promoter will not use the personal information for a different purpose without
first obtaining the participants’ permission. The promoter keeps personal information
to fulfil the purposes for which it was collected or as required by applicable laws or
regulations and the promoter’s privacy policy: https://twizza.co.za/privacy-policy/.
Apart from the promoter’s affiliates and service providers for the fulfilment of (a), (b),
and (c), the promoter will not allow third parties to use the participants’ personal
information. Participants, however, agree that their personal information may, in
appropriate circumstances, reside outside of South Africa, and hereby agree to the
transfer of their personal information to locations outside of South Africa and the use
of such personal information outside of South Africa.
26. The promoter will take reasonable steps to ensure that the data is complete, accurate,
and not misleading.
27. The promoter will ensure that there are sufficient security measures in place to
safeguard data storage and handling for the duration of the retention period.
28. Data will be stored for a period not exceeding 3 (three) years.
29. Any questions, comments, or complaints regarding the competition can be directed to
the promoter via email at marketing@twizza.co.za during office hours (between 8h00
AM and 17h00 PM, Monday to Friday, excluding public holidays).
