TERMS AND CONDITION

Please read these terms and conditions carefully. Participation in this Promotion will constitute your agreement to comply with these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not participate.
The terms and conditions set out below apply to all participants in the #FakaiFlava Promotion taking place on Facebook and Instagram.

RULES OF COMPETITION:

  1. The name of the competition is “Twizza #FakaiFlava” (“the competition”) and the promoter is Twizza (Pty) Limited (Registration number 2012/221184/07), a company incorporated in the Republic of South Africa, and having its registered address at 1 Arkwright Street Queendustria Queenstown 5319 (“the promoter”).
  2. The competition runs from 25 October 2023 and ends 20 December 2023.
  3. The competition is open to all citizens and legal residents of South Africa (provided that the participant is also a resident in South Africa at the time of winning and receiving any prize in this competition), who at the time of entering the competition are over the age of 18 (eighteen) years, and are in possession of a valid South African Identity Documents (in the case of residents, a valid passport, and necessary residency permits).
  4. No employees, directors, agents or consultants and their immediate family members directly connected to or in the employment of Twizza (Pty) Limited, their subsidiaries and business partners, associated, advertising or promotion agencies and staff members, who within a period of 3 months preceding this competition has won any competition organised, promoted or conducted by Twizza (Pty) Limited, or who resides at the same address as such a winner may take part in the competition.
  5. To increase chances of winning, participants may enter as many times as they like during the competition period. However, each participant may only win once for the duration of the competition. 
  6. Each entry will be audited, and participants stand a chance to WIN 1 (one) of the following prizes: 
    1. Three winners will each win their share of a makeover to the value of R150 000* for their hood (R50 000 ALL inclusive, per community. The fixture will not exceed R50 000).
    2. 12 winners will receive R2000* for nominating their communities. 
  7. To enter the competition, the participant must:
    1. Comment on our social post and tell us why we should Faka iFlava (revive their community)
    2. Tag #FakaiFlava
  8. Winners will be internally audited from 25 October 2023 – 20 December 2023. Should a winner not meet any of these criteria mentioned in point 3, Twizza (Pty) Limited reserves the right to withdraw their entry.
  9. Winners will be contacted via DM on the social media handle they used to enter or the phone number they have provided. Conversations and other entry details (including social media handles) may be recorded for security, auditing, and verification purposes. 
  10.  To claim their prize, each winner will be contacted via the post they entered on, on their Facebook, Instagram, or X pages, and need to respond within 48 hours. 
  11.  Renovations may not start immediately, a representative of the promoter will contact winners requesting relevant details, and prize money will be sent within 5-10 business days once the participant has provided us with their relevant details. If required, we may also request additional documentation or information.
  12.  Winners may be announced on the Twizza Facebook page (https://www.facebook.com/Twizza), X page (https://twitter.com/Twizza_ZA), or Instagram page (https://www.instagram.com/twizza/).
  13.  All entries become the property of the promoter and may be used at their sole discretion.
  14.  The promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries.
  15.  The promoter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer online systems, servers, or providers, computer equipment, software, failure of any entry to be received by the promoter on account of technical problems, human error, or traffic congestion on any of the cellular device relating to, or resulting from, participation in the competition or use of the requisite instructions of the competition. Proof of sending will not be accepted as proof of receipt.
  16.  Participation in the competition constitutes acceptance of the promotion rules and participants agree to abide by these rules.
  17.  Except insofar as is provided for in the Consumer Protection Act (Act 68 of 2008), the promoter’s decision is final, and no correspondence will be entered into after the competition’s closing fate.
  18.  Prizes are not transferrable, cannot be converted to any other prize, and may not be deferred to a later period.
  19.  The promoter or it agents, its associated companies, nor any directors, officers, nor employees of such, do not accept responsibility or liability for any loss or damage to goods or personal injury, whether direct, indirect, consequential or otherwise arising from any cause whatsoever, suffered as a result of participating or winning this prize, and will also not be responsible or liable for any further expenses or fees required for purpose of using, applying or enjoying the prize won in the competition.
  20.  The promoter shall have the right to change or terminate the competition immediately and without notice. In the event of such change or termination, all participants agree to waive any rights that they have in respect of this promotional competition an acknowledge that they have no recourse against the promoter or its agents.
  21.  The promoter reserves the right to publish any images taken of the participants for publicity purposes in any manner they deem fit, without any remuneration being made payable to the participants. However, the participant has the right to object to these images being used by written notification to the legal department of the promoter or its agents.
  22.  The competition is in no way organised, endorsed, or administered by, or associated with Facebook, LinkedIn, Instagram, X or any other social media forum.
  23.  By participating in the competition, participants consent to the transfer, storage, and processing of their personal information. Participants may withdraw this consent at any time by written notification to the promoter: twizzatwenty@gmail.com. The promoter and its affiliated will collect and use the personal information:
    1. To enable participation in this competition
    2. For activities related to this competition
    3. For the promoter’s, its affiliates, and subsidiaries’ marketing purposes
    4. For communication to participants about products and offers from the promoter.
  24.  The promoter will not use the personal information for a different purpose without first obtaining the participants’ permission. The promoter keeps personal information to fulfil the purposes for which it was collected or as required by applicable laws or regulations and the promoter’s privacy policy: https://twizza.co.za/privacy-policy/. Apart from the promoter’s affiliates and service providers for the fulfilment of (a), (b), and (c), the promoter will not allow third parties to use the participants’ personal information. Participants, however, agree that their personal information may, in appropriate circumstances, reside outside of South Africa, and hereby agree to the transfer of their personal information to locations outside of South Africa and the use of such personal information outside of South Africa. 
  25. The promoter will take reasonable steps to ensure that the data is complete, accurate and not misleading.
  26. The promoter will ensure that there are sufficient security measures in place to safeguard data storage and handling for the duration of the retention period.
  27. Data will be stored for a period not exceeding 3 (three) years.
